Terms and Conditions
Allotment: Allotment shall be made on first come first serve basis on receipt of the booking money as per application.
Allotment Preference: Buyers willing to make onetime payment will be given preference and 5% discount may be allowed to them except on the booking money and cost of parking space.
Allotment Transfer: Until full payment of the instilments, the buyers shall not have the right to transfer the allotment to a third party without the concern of the company. Transfer the apartment to other than family members, transfer fee shall be 4% of the cost.
Payment:
a) All payment has to be made by crossed cheque/bank draft/pay order. No payment in cash will be accepted in any circumstances.
b) The buyers must strictly adhere to the schedule of payment to ensure timely completion of the construction work. Any delay in payment as per allotment letter more than 7 days, the buyer shall have to pay 3% delay charge per month on the payable amount. If the payment is delayed beyond 60 days the company shall have the right to cancel the allotment without any notice. In that case the amount paid by the buyer will be refunded after deducting Tk. 2,00,000/- (Two Lac) after resale of the cancelled flat.
Cancellation of Booking: In case of any cancellation of booking / allotment of an apartment by a client, the amount deposited will be refunded after selling of that apartment to the new buyer and on deduction of incidental charges of Tk. 2,00,000/- (Two Lac) only.
Down Payment: Purchaser shall have to pay the down payment within 15 days of booking or as per payment schedule agreed by both party specified in application form and allotment letter. Otherwise booking will be automatically cancelled without any notice and the booking money will be forfeited.
Company’s Right: The Company reserves the right to accept or reject any application for allotment of apartment. The Company may make minor changes in the design and specification of the project if become necessary.
Registration Costs: The buyer shall bear all costs relating to registration (such as, stamp, All Tax, VAT, Legal fees). The Company will make necessary arrangement for all such formalities.
Incidental Costs: Utility connection fees, flat owner’s cooperative society fee and other incidental charges and costs relating to Water, Sewerage, Power connection, solar system etc. are not included in the price of the apartment. The Company will make those payments directly to the concern authorities on allotter’s account. The allottee shall have to pay those charge flat wise on actual cost basis before taking handover/possession of the apartment.
Hand Over Of Possession: The possession of the apartment & parking space will be handed over on receipt of full payment and on completion of all works as per time schedule of the company.
Apartment Owner’s Welfare Society: The buyer/flat owners must become a member of the “Western Kayra Plaza” flat owners association. The Western Engineers Ltd will be the owners of the major numbers of flat and their company’s head office also will be at “Western Kayra Plaza”. Therefore the Managing Director of The Western Engineers Ltd shall be the Chairman of the Western Kayra flat owners association forever. Each buyer/flat owners of the apartment shall have to deposit Tk. 25,000/- (Taka Twenty Five Thousand) only initially for one time deposit for the common service cost such as pumps, electric generator, lift and annual maintenance of the building etc. The flat owner shall have to bear the electric and gas bill as per consumption as their own flat. The monthly utility service expenses will be borne by the owners as per requirement which will be decided by the company until formation of owners association and after formation of flat owners association that will be decided by the association.
Time of Completion: The time of completion of the project is calculated on December 2022.
** Later on if any other issues arise, it will be displayed in application form of Agreement.
